It shall be unlawful for any person, firm, association, partnership or corporation to construct, erect or maintain grain storage facilities on any real estate located within the City Limits of the City of Bird City, Kansas; without first submitting an Application for Building Permit to the City Clerk, to be voted on at the next City Council meeting.

Except as provided in sections 4-902 and 4-903 and except that such facilities shall be permitted on a strip of real estate One Hundred Fifty Feet (150’) wide along and adjacent to the south side of U.S. Highway No. 36.

New grain storage facilities will only be considered by a properly submitted Building Application and approval by the City of Bird City, City Council.

All grain storage facilities existing on the real estate described in section 4-901 at the time of the adoption of this article may be continued, but may not be structurally altered to an extent which exceeds the aggregate in value during any ten-year period of the value of forty-percent (40 percent) of its assessed value and then only if there is full and complete compliance with the current building permits.

If an existing grain storage facility is removed from the real estate at any time during the period this article is in effect, it may not be replaced with another such facility, unless a permit is applied for and granted pursuant to section 4-902.

Nothing contained in this article shall require any change in the plans, specifications, construction or designated use of any building or other structure for which a building permit has already been issued and the construction of which shall have been or shall be diligently prosecuted within a reasonable time from the date of such permit.

The provisions of this article may be enforced by the Mayor and city council under such rules and regulations, as they may consider necessary. The owner or owners of any building, structure, premises or part thereof, where anything in violation of this article shall be placed, or shall exist or be maintained, and any architect, builder or contractor who may be employed to assist in the commission of any such violation and any person, firm, partnership or corporation who shall violate or maintain any violation of any of the provisions of this article, or who shall fail to comply with such provisions, or who shall build or construct in violation of any permit issued hereunder, may, for each and every violation or noncompliance, be guilty of a misdemeanor and, upon conviction thereof, shall be fined an amount not to exceed Five Hundred dollars ($500.00); and each day during which such violation or noncompliance shall continue may constitute a separate offense.
