There has been established in the City of Bird City, Kansas, a recycling program for the benefit of the citizens of Bird City, Kansas. Said recycling program consists of 10 bins used for the collection of those materials that are recyclable as so indicated on said bins. This recycling facility is located to the east of the Bird City City Shop on Third Street, Bird City, Kansas. Said program is to be implemented by the City of Bird City, Kansas, and maintained by the City of Bird City, Kansas.

There is hereby established in the City of Bird City, Kansas, a fee for the recycling program in the amount of $1.50 per month per active city utility meter within the City of Bird City, Kansas, excluding those city utility meters as used by the City of Bird City, Kansas. Said fee is to be collected monthly from each said meter, and the recycling fees as collected pursuant hereto shall be paid the City of St. Francis, Kansas, to reimburse the City of St. Francis, Kansas, for expenses associated with recyclables as processed by the City of St. Francis, Kansas, for the City of Bird City, Kansas.

The recycling facility is only for the collection of those items that are recyclable which are indicated on the bins located at the recycling facility. Any person who deposits in the recycling bins items not so indicated on the bin for the collection therein, has committed an unauthorized use of said recycling facility. Penalty for said unauthorized use shall be in the amount of $50.00 per bin per unauthorized use.
