Subject to any provision prohibiting parking at all times or during specified hours, vehicles used for the transportation of merchandise or materials may stand or be parked at the curb to take on or discharge loads on any street marked parallel parking; PROVIDED, that such vehicles may be backed into any curb at such times and places where and where the same may not interfere with or become a hazard to vehicular traffic on such street within the block; PROVIDED FURTHER, that traffic may be temporarily blocked by any such vehicle backed into any curb to load or unload when the same may be necessary and is undertaken in an expeditious manner without delay, upon prior notice to and under the direction and supervision of a police or law enforcement officer; PROVIDED FURTHER, that the driver or some person in charge of such vehicle shall constantly be present or available to remove such vehicle in an emergency and the vehicle shall be removed immediately upon the same being loaded or unloaded as the case may be. A police or law enforcement officer may place suitable warning signs to direct or control traffic curing the time any street may be blocked or traffic restricted from its normal flow or course

(a) It shall be unlawful to park a truck with an actual gross weight of more than Twenty-four Thousand (24,000) pounds or a bus, truck tractor, road tractor, farm tractor, trailer or semitrailer on any street in a residential district for longer than four (4) hours; except that parking longer than four (4) hours is permitted when it is necessary for loading or unloading of merchandise and a permit has been issued by the police or law enforcement officer. These permits shall be issued for each instance where parking beyond 4 hours is necessary.
(b) Except as otherwise provided herein, any trailer or semi-trailer parked within the city limits of Bird City, Kansas, be it on public property or private property, shall be clean so as to not emit any offensive, disagreeable or nauseous odors caused by grain, com, ashes, cinders, slops, filth, excrement, wood, lumber, sawdust, stones, rocks, dirt, straw, soot, sticks, shavings, oyster shells, cans, paper, trash, rubbish, decayed fruit, vegetables, broken wares, rags, oil, old wearing apparel, all animal or vegetable matter, all dead animals, green or unsalted hides, or other offensive or disagreeable substances.
(c) If there should be any trailer or semi-trailer parked within the city limits of Bird City, Kansas, be it on public property or private property, which is emitting an offensive, disagreeable or nauseous odor, upon a written statement from the complaining citizen signed by said citizen, the Chief of Police or other law enforcement shall cause said trailer or semi-trailer to be removed from the city limits of Bird City, Kansas, be it by way of contacting the owner or operator thereof to remove the same or by way of having said trailer or semi-trailer towed at the expense of the owner.

It shall be unlawful for any person, firm or corporation, to disconnect from a tractor designated to pull a semi-trailer, so that any part of such semi-trailer is supported by dollies or support not bearing on a tractor designed to pull such semi-trailer unless the owner or person in possession complies with the remaining provisions of this section.
(a) Any person leaving a semi-trailer disconnected from a tractor shall cause to be placed between the dollies and support the trailers and pavement, a wooden plank of such thickness and width, that no portion of the semitrailer other than wheels with pneumatic tires coming in contact with the pavement. Such plank shall be thirty-six inches (36”) in length and of such thickness that it does not break, crush or crumble and so that the weight will be distributed over the entire length of the plank.
(b) Any semi-trailer so parked must comply with the provisions above as to parking time limits.

It shall be unlawful for any person, business or corporation to park or permit any bus or tractor with a registered gross weight of twenty-four thousand (24,000) pounds or more or any tractor, trailer, semi-trailer or similar vehicle or part of a vehicle to be parked or to be so left, whether attended or unattended, such roadways or streets as the city council may designate by resolution.

If any such vehicle or trailer, as identified in this section, shall be so parked or placed, deposited or left unattended upon any street, avenue, alley, public-way or right of way, the same shall be removed by the owner within twenty-four (24) hours after a citation is issued by a police or law enforcement officer. If such vehicle or trailer is not removed within said twenty-four (24) hour time period, the same shall be caused to be removed by a the police or law enforcement officer in the most reasonable manner. Said vehicle shall not be returned to the owner until the towage and storage charges are paid in full to the City of Bird City, Kansas. In the event said vehicle or trailer is not claimed and wage and storage charges paid in full within sixty (60) days from the date of the impoundment, the appropriate law enforcement official shall proceed to sell such vehicle or trailer as an abandoned vehicle, pursuant to and in accordance with K.S.A. 8-1102, as amended, and such payment and/or sale shall not relieve the owner of said vehicle or trailer of prosecution for said violation.

It shall be unlawful for the driver of any vehicle to use or operate or cause to be used or operation with the City of Bird City, Kansas, any mechanical exhaust device designed to aid in the stopping or braking of said vehicle, in a manners as to created excessive, loud, or unusual or explosive noise from the vehicle.

Any person violating this article, shall, upon conviction thereof, be punished by a fine of not less than $25 nor more than Five Hundred Dollars ($500).
