The Basic Plumbing Code, Edition of 1978, published by the Building Officials and Code Administrators International, Inc., 1313 East Sixtieth Street, Chicago, Illinois 60637 for the practice of plumbing, including the installation, maintenance, extension and the alteration of all pipes, fixtures, appliances and appurtenances in connection with sanitary sewers and public and private water systems is hereby incorporated by reference herein as the Plumbing Code of the city. The said Code shall be the minimum standard for all plumbing work done or performed under the provisions of this article except as hereinafter provided. Three (3) copies of the Basic Plumbing Code shall be kept on file by the City Clerk for inspection by and use of the public and shall be marked with the words by and use of the public and shall be marked with the words “Official Copy as Incorporated by the Code of the City of Bird City.”

The person chosen to fill the office of plumbing inspector shall be of good moral character, shall be possessed of such executive a ability as is required for the performance of his duties and shall have a thorough knowledge of the standard materials and methods used in the installation of water, gas and sewer equipment, shall be well versed in approved methods of construction of safety to persons and property, the statutes of the State of Kansas relating to plumbing work and this article. The plumbing inspector and his deputies shall be appointed by the mayor, by and with the consent of the city council.

The plumbing inspector and his deputies shall not engage in the private plumbing business for hire, either directly or indirectly in the city and shall have financial interest in any concern so engaged in the city while holding office of plumbing inspector or deputy for all or part of the time.

The plumbing inspector and his deputies shall inspect all plumbing hereinafter 1nstalled in r upon any building or structure in the city and shall inspect all such installations and apparatus for conformity with the provisions of this article.

The plumbing inspector shall have the power and authority to condemn and cause the removal or necessary repair of any plumbing in or upon any building or structure within the city which may be found dangerous to life or property. He shall have the authority for the cutting off of water service there from until such repairs or changes are made: Provided, That before condemning any plumbing work as unsafe or defective, or not in compliance with the provisions of this article, the said inspector shall at once notify the party of parties doing such work and/ or the owner of the premises, and shall order him or them to change, re-arrange or remove same. Upon the party’s or parties’ failure or refusal to do so within fourteen (14) days, such party or parties shall be deemed guilty of a violation of the provisions of this article; each and every day which shall elapse after the expiration of the time specified in the notice to correct any unsafe, detective or unsatisfactory work to comply with said order shall be considered a separate offense hereunder.
